Insolvency law and restructuring
We advise your company and the board members on refinancing, negotiations with investors and creditors, out-of-court composition and insolvency proceedings. In international insolvency proceedings, this also includes recognition of foreign insolvency decrees in Switzerland for the assertion of Swiss assets and claims against Swiss debtors in favour of the foreign bankrupt's estate and creditors.
We advise corporate bodies in connection with impending payment difficulties on the best options to avoid personal liability due to delayed bankruptcy or preferential treatment of creditors and on defence against liability claims. Our representation of creditors also includes assertion of claims against insolvent companies, representation in the creditors' committee as well as assertion of claims, including liability and rescission claims.
Governance, compliance and commercial criminal law
We have extensive experience in the implementation of governance and compliance structures in medium- to large-scale businesses. This includes matters of internal regulations as well as the drafting and handling of codes of conduct. Managing the processes relating to whistleblowing is also part of our area of expertise.
We also advise your company and its management on suspected criminal activity by employees as well as on governance and compliance grievances. If required, we are able to represent you in internal and external investigations.
